Golden Visa

The Golden Visa Program was created by the Portuguese authorities to enable foreign investors, outside the European Community, to be granted a valid residence visa to live and work in Portugal, through an investment in the country.

The visa is valid for one year and is renewable in consecutive 2 year periods

Declaration duly signed by the applicant, where he/she assumes the responsibility to maintain the premises with the investment

The requirements must be maintained for a minimum period of 5 years.

 

WHO CAN APPLY 

All third countries citizens, who carry out an investment activity, personally or through a company incorporated in Portugal or in another E.U. state, with a permanent establishment in Portugal, and who meet one of the requirement foreseen:

     

    REAL ESTATE INVESTMENT

    With the aim of promoting investment in the country’s interior, in urban regeneration and cultural heritage, and to favor job creation, as of January 1, 2022, the legal regime for obtaining residency through investment in Portugal will undergo the following changes.

    Real Estate Investment

    • A minimum amount of 500,000.00 € for residential purposes will only be permitted in the interior of Portugal, the Azores and Madeira.
    • In the minimum amount of 350,000.00 € with rehabilitation works, for residential purposes, will only be permitted in the interior of Portugal, Azores and Madeira.

    Money Transfers

    • The transfer of capital in the amount equal to or greater than 1 million euros, changes to a minimum investment of 1.5 Million
    • The minimum investment amount in the transfer of capital for application in research activities developed by public or private scientific research institutions, integrated in the national scientific and technological system, is increased from 350,000.00 euros to 500,000.00 euros.
    • The minimum investment amount in the transfer of capital for investment in Private Equity Funds is increased from 350,000.00 € to 500,000.00 €.
    • The minimum investment amount in the transfer of capital for the establishment of a company in Portugal, provided that it creates five permanent jobs, or for the increase of the share capital of a Portuguese company, with the creation or maintenance of such jobs, is increased from 350,000.00 € to 500,000.00 €.

     

    To request the visa, the proof of this investment is assumed:

    • Certificate of Real Estate Registry
    • Promissory Contract, if applicable
    • Declaration of the financial institution, certifying the transfer of foreign capital

     

    Taxes

    • IMT (Property Transfer Tax) – paid by the new owner immediately before the purchase
    • IS (Stamp Tax)
    • IMI (Municipal Property Tax) – tax paid annually by the respective owner as of December 31 of the previous year

    Benefits

    • Visa exempt for moving within the Schengen area
    • The residence permit is extended to the remaining members of the household – spouse; minor children; adult children if dependent; the applicant’s parents, if dependent on the applicant
    • The minimum periods of residence in Portugal are reduced
    • May continue to reside in another country
    • Perpetual residence after 5 years
    • Can apply for Portuguese citizenship after 6 years
    • Recognition of diplomas and professional certificates
    • The holder and his family have access to the same benefits guaranteed to Portuguese citizens by the State
    • Public health system
    • Courts
    • Public and private education
    • Equal treatment in relation to tax benefits

    O Programa Golden Visa foi criado pelas autoridades portuguesas para possibilitar que investidores estrangeiros, fora da Comunidade Europeia, pudessem obter um visto de residência válido para viver e trabalhar em Portugal, através de um investimento no País.

    O visto é válido por um ano e é renovável em períodos consecutivos de 2 anos

    Requisitos

    • Ausência de dívidas à Autoridade Tributária Portuguesa e à Segurança Social
    • Seguro de Saúde
    • Declaração devidamente assinada pelo requerente, onde assume a responsabilidade de manter as premissas assentes com o investimento
    • Os requisitos terão de se manter por um período mínimo de 5 anos

     

    INVESTIMENTO IMOBILIÁRIO

    Com o objectivo de promover o investimento no interior do País, na requalificação urbana e no património cultural e de favorecer a criação de emprego, a partir do dia 1 de Janeiro de 2022, o regíme jurídico para obtenção de residência para investimento em Portugal passou a compreender as seguintes alterações:

    Investimento Imobiliário

    • No montante mínimo de 500.000,00 € para fins habitacionais, apenas será permitido no interior de Portugal, Açores e Madeira.
    • No montante mínimo de 350.000,00 € com obras de reabilitação, para fins habitacionais, apenas será permitido no interior de Portugal, Açores e Madeira.

    Transferência de Capitais

    • A transferência de capitais no montante igual ou superior a 1 milhão de euros, passa para um investimento mínimo de 1.5 Milhões.
    • O valor de investimento mínimo na transferência de capitais para aplicação em atividades de investigação desenvolvidas por instituições públicas ou privadas de investigação científica, integradas no sistema científico e tecnológico nacional, passa de 350.000,00 € para 500.000,00 €
    • O valor de investimento mínimo na transferência de capitais para investimento em Private Equity Funds, passa de 350.000,00 € para 500.000,00 €.
    • O valor de investimento mínimo na transferência de capitais destinados à constituição de sociedade em Portugal, desde que com a criação de cinco postos de trabalho permanentes, ou para reforço de capital social de uma sociedade portuguesa, com a criação ou manutenção desses postos de trabalho, passa de 350.000,00 € para 500.000,00 €.

    Para solicitar o visto, pressupõem-se os comprovativos deste investimento:

    • Certidão do Registo Predial
    • Contrato de Promessa, se aplicável
    • Declaração da Instituição financeira, que certifique a tranferência de capitais estrangeiros

    Impostos

    • IMT ( Imposto Municipal sobre a Transacção onerosa de Imóveis) – pago pelo novo proprietário imediatamente antes da compra
    • IS (Imposto de Selo)
    • IMI (Imposto Municipal sobre Imóveis) – imposto pago anualmente pelo respectivo proprietário a 31 de Dezembro do ano transacto

    Vantagens

    • Isenção de visto para circular no espaço Schengen
    • A autorização de residência estende-se aos restantes membros do agregado familiar – cônjuge; filhos menores; filhos maiores desde que dependentes; aos pais do requerente, desde que dependentes deste
    • Os períodos mínimos de residência em Portugal são reduzidos
    • Pode continuar a ter residência noutro País
    • Residência permanente ao fim de 5 anos
    • Pode requerer a cidadania portuguesa depois de 6 anos
    • Reconhecimento de diplomas e certificados profissionais
    • O titular e a respectiva família têm acesso aos mesmo benefícios garantidos pelo estado social de direito aos cidadãos portugueses :
    • Sistema público de saúde
    • Tribunais
    • Ensino público e privado
    • Igual tratamento em relação a benefícios fiscais
    • Segurança Social
